摘要
尽管我国通过立法作出禁止性规定,将教师体罚学生明确界定为违法行为,但教师体罚现象仍时有发生,对受害学生的身心健康及各项合法权利造成了侵害。教师体罚现象的社会根源主要在于法制体系缺失、部分教师依法施教能力有待提高、传统教育观念根深蒂固等方面。建议今后从教师惩戒权法制化、严格执法、加强教师群体思想教育与构建公众参与的监督机制入手,规制教师体罚现象。
By means of legislation, the country has made a prohibitive provision to clearly define the teachers' corporal punishment as an unlawful act, but the teachers" corporal punishment is still repeated, which caused severe infringement in terms of students" physical-mental health and various legal rights. Social causes of the phenomenon of teachers" corporal punishment can be attributed to the lack of legal system, poor awareness of teaching in accordance with laws, and inveteracy of the tradi- tional educational concepts. Concerning these social causes, this paper suggests legalizing the discipli- nary right of teachers, tightening regulation of teachers" use of the right, strengthening teachers." ideological education, and building a monitoring institution with the public participation. It is hoped that these suggestions can help effectively regulate the phenomenon of teachers" corporal punishment.
