摘要
"通知-删除"规则对网络服务商和网络版权权利人都具有重要的意义。现有的"通知-删除"规则未能对"及时"做出准确判断。对于合理删除时间的判断,应当综合考虑以下因素:侵权通知书是否合格;权利人是否明确删除期限、侵权类型、删除的难易程度等。
＂Notice - deletion＂ rule is important to both intemet service providers and copyright holders. Current ＂Notice - dele- tion＂ rules cannot make accurate judgment of ＂timely＂. Following factors should be included in the judgment of reasonable deletion - time, i.e. whether an infringement notice is qualified; whether copyright holders have set the deletion deadline; what type of infringement is involved; and what difficulty of level the deletion is at, and so on.
