著作权范围的模型建构与学理界定

The Model Construction and Theoretical Definition of Copyright Scope

摘要 思想表达二分法并非是对作品"思想"与"表达"的简单分割,而是将作品划分为"思想"与"表达"两个基本维度,界定著作权范围的理论方法。著作权范围的法律界定是侵权认定的逻辑起点。中国著作权的立法并没有吸收二分法理论,但司法上已采取"实质性相似+接触"的侵权认定规则。应当立足于思想表达二分法对著作权范围进行学理界定,从而保证"实质性相似+接触"规则的准确适用。 The Idea/Expression Dichotomy is not a simple division of the "thought" and "expression" of the work, instead, it provides a theoretical way to define the copyright scope by dividing the work into two basic dimensions of "idea " and "expression". In the jurisprudence, the definition of the copyright scope is not only the prerequisite for infringement, but also the logical starting point of the rules of infringement judgement. China's copyright law does not absorb the theory of dichotomy, but the infringement judgement rules of "substantial similarity + contact" have been taken in judicial practices. A definition on the copyright scope should be based on the Idea/Expression Dichotomy, so as to ensure a precise application of the "substantive similarity + contact" rule.
