摘要
为了优化司法职权配置,克服地方保护主义,推动法院实现审判权和执行权相分离,十八届四中全会正式提出最高人民法院设立巡回法庭的改革措施,用以逐步推进司法独立和司法公正。文章将展现巡回法庭改革措施的提出过程,阐述巡回法庭的功能,分析最高人民法院巡回法庭在审级设置、案件分工等方面存在的问题,并借鉴我国巡回法庭在试点中突出的亮点,以及美国联邦巡回上诉法院在推动司法独立措施中的部分经验,提出最高人民法院巡回法庭的制度构建。
In order to optimize the distribution of judicial powers, overcome regional protec- tionism, and separate judicial authority and the right of execution, the 4th plenary session of 18th CPC Central Committee formally put forward the reform measures that the Supreme Court should set up circuit court. The process of proposing this reform is described. The function of the circuit court is explained. The problems of trials level settings and case division are analyzed. The system construction for the circuit of the supreme court is proposed by considering the highlight in the experiment and the experiences of CAFC.
