摘要
网约车在"互联网+"的政策推动下已成为当下消费者喜闻乐见的一种出行方式,但网约车司机和乘客之间产生了诸多新的法律问题,而当前的立法和司法并无适合的纠纷解决机制来应对。要想解决问题,必须要分析问题的性质,找准纠纷双方的法律主体地位,将网约车司机作为独立的经营者来考虑,同时充分认识现行法律中网约车司机合法权益保护方面存在的不足,通过明确网约车司机合法权利内容、引入网约车"黑名单"制度、完善网约车司机维权平台等多种措施来保护网约车司机合法权益。
Car - hailing service as convenient transportation becomes a kind of popular way to travel for the consumers in the " Internet plus" policy. There are many new legal issues arising from new legal facts between the driver and the passenger of car - hailing service, and there is no suitable dispute resolution mechanism to deal with them. If we want to solve the problem, we should analyze the nature of the problem and identify the legal subjects of the two sides of the dispute. It is to consider the driver of ear - hailing service as an in- dependent operator, solve the unreasonable provisions of the existing law on the operators, stipulate the legal fight contents and introduce the "black list" system of car - hailing service to protect their rights and interests.
