摘要
新加坡知识产权局通过与WIPO合作针对专利撤销案件向当事人提供专家裁决程序及服务。新加坡知识产权局引入WIPO专家裁决程序主要有两个方面的特点,它注重WIPO专家裁决程序与本身听审程序的融合以及专家裁决程序的服务质量。我国可以从三个方面进行借鉴:扩宽专撤销案件的处理渠道,引入专家裁决等非诉讼程序;注重专家裁决程序与专利复审委员会审理程序的融合与衔接;强化专利撤销案件专家裁决处理结果的效力。
The Intellectual Property Office of Singapore provides the expert determination procedures and services to the parties through cooperation with WIPO in respect of patent revocation cases. The introduction of the expert determination from WIPO by the Singapore Intellectual Property Office has two main characteristics, which focus on the integration of the expert determination with its own hearing procedures and the quality of service of the expert determination. We can learn from three aspects： to broaden the channels of dealing with patent revocation cases, by introducing the expert determination; to focus on the integration and convergence of expert determination procedures and the hearing proceedings in Patent Reexamination Board; to strengthen the effectiveness of results from expert determination in the patent revocation cases.
