摘要
本文主要分析美洲人权法院体系中人权保护条款执行的监督机制。美洲人权法院判决建立了两类国际性标准:具有条约性效力的标准和具有解释性效力的标准。秘鲁宪法法院与美洲人权法院的司法判决标准发展具有近似性。美洲人权法院判决的条约性和解释性内容,通过案例援引和司法理论构建两个途径,对秘鲁宪法法院产生影响。美洲人权法院判决条款可分三类:具有条约约束力的、一般效力的或判决对法律无定性解释的。本文选取美洲人权法院案例进行分级,梳理上述判决内容的三级影响效力。文章还反思和评述了人权条约的监督机制,该机制使宪法条款和国家法律逐步纳入美洲人权公约和美洲人权法院的管辖。新时期,宪法国际化和国际法宪法化进程还需美洲人权法院与国家法院间的对话。
This article focuses on the monitoring mechanisms for the implementation of human rights protection provisions in the inter-American human rights system. The Inter-American Court of Human Rightsestablished two types of international standards ： standards with treaty effectiveness and standards with interpretative effectiveness. Concerning to the development of the Judicial Judgment Standard, the Peruvian Constitutional Court has similar characteristics with the inter-American Court of Human Rights. Through approaches of binding precedents and jurisprudential principle, the two types of standards established by inter-American Court of Human Rights hasinfluenced the Peruvian Constitutional Court. The judgments of the Inter-American Court of Human Rights can be divided into three categories： treaty-binding, general-effect andno fixed interpretation of the law. This article classifies the judgements of the Inter-American Court of Human Rights into threestages of effect, which were mentioned above. The article also reflects on and reviews the monitoring mechanism of human rights treaties, which make the constitutional provisions and national laws gradually incorporated into the jurisdiction of the In-ter-American Convention on Human Rights and the Inter-American Court of Human Rights. Looking forward to the new era, a dialogue between the Inter-American Court and the national courts is required to promote internationalization of Constitutional Law and theconstitutionaliza- tion of International Law.
