摘要
由于交易费用的存在,农地产权不能得到完全界定,致使一部分产权落入了农地产权公共域。处于公共领域中的产权是一种稀缺的资源,当各相关利益主体均想获取时,就会引发争夺利益冲突。产权公共域的存在,不仅会造成交易双方的利益冲突,还必然会造成资源的耗散,农地资源配置的低效率。本文以产权公共领域为切入点,结合产权公共领域与农地权利冲突的关系,对我国农地权利冲突类型及其原因进行深入分析,最后从缩小产权公共领域明晰农地产权的角度,提出农地产权制度改革的对策建议。
Because of the existence of the transaction cost,the property rights cannot be fully defined,which lead to some farmland property rights fall into the public domain.Property rights in the public domain are scarce resources that create interest conflicts when the interested parties are interested in obtaining them at the same time.The existence of the property rights in the public domain not only causes the interest conflicts of the two parties,but also causes the dissipation of resources and the inefficient allocation of farmland resources.Starting from the property rights in the public domain,combined with the relationship between the property rights in the public domain and the farmland right conflicts,this paper analyzes the types of the property right conflicts and the reasons,and puts forward the countermeasures and suggestions in the reform of the system of the farmland property rights to narrow the property rights in the public domain and clarify the farmland property rights.
