摘要
民营企业是社会主义市场经济的重要组成部分,但一些民营企业家缺乏法治意识、责任意识,在企业融资、财务管理、贸易以及产品质量等方面铤而走险,导致民营企业家的犯罪率不断攀升,在一定程度上制约着市场经济的发展。民营企业家犯罪的背后,暴露出民营企业在运行、管理、监督等环节上存在着制度性缺陷,应从法律风险管理的理念、机制、组织和方法等方面进行健全完善,并与企业生产经营、管理有机地结合起来,形成防范体系,有效预防民营企业家犯罪。
Private enterprises are an important part of the socialist market economy. However, some private entrepreneurs lack the sense of the rule of law, the sense of responsibility, and take risks in the aspects of corporate finance, financial management, trade and product quality, which lead to the climbing of crime, to a certain extent, restricts the development of market economy. In the back of the crime of private enterprises,exposing the existence of institutional defects of the private enterprises in the operation, management,supervision and other aspects, so should be from the legal risk management concept, mechanism,organization and methods to improve and perfect, and combine production and operation to form a preventive system, and effectively prevent private entrepreneurs crime.
