摘要
【目的/意义】网络信息资源著作权在虚拟的电子网络环境中面临诸多风险,如何有效规避网络信息资源著作权风险是新时期维护良好的网络版权秩序必须解决的一大难点。【方法/过程】本文运用演化博弈理论的分析方法,构建了网络信息资源著作权风险的演化博弈模型,通过建立相应的复制动态方程探讨网络信息资源著作权风险的演化博弈均衡。【结果/结论】网络信息资源著作权人与传播者的策略选择受多种因素的共同影响,系统不会固定收敛于某一个均衡策略集合;其中监管成本、维权成本、支付成本、处罚力度等因素会直接影响系统的演化方向。
[Purpose/significance] In virtual electronic network environment, there are lots of risks for the copyright of network information resources, and how to circumvent the copyright risks effectively is one of the troublesome tasks to maintain a good network copyright order. [Method/process] The evolutionary game theory was introduced to construct the evolutionary game model of copyright risks. After building the corresponding replicated dynamic equation, we discussed the evolutionary game equilibrium of the risks. [Result/conclusion] The strategy selections between copyright owners and spreaders are affected by many factors and the system will not converge to a fixed collection equilibrium strategies. Some factors, including the regulatory costs, safeguarding rights costs, payment cost, punishment intensity and other factors, will directly affect the evolution direction of the system.
