摘要
21世纪以来,我国教师惩戒权研究经历了兴起和发展两个阶段。研究者在国外借鉴、理论探讨和状况调查三个方面进行了系统的研究。在国外借鉴方面,美国、英国、韩国的教师惩戒权立法经验为我国开展教师惩戒权研究提供了重要启示;在理论探讨方面,研究者对教师惩戒权的属性、内涵、行使原则、立法等方面进行了广泛的探讨;在状况调查方面,研究者探讨了教师惩戒权行使中的问题、原因以及规范策略。未来我国教师惩戒权研究应注重以下几个方面:重视教育家惩戒思想和实践的研究、加强国外教师惩戒权相关法律法规的研究、开展教师惩戒权立法系统性的研究、继续推进教师惩戒权的实证研究等。
Since the 21st century, the research on disciplinary power of in China has experienced two stages: rising and development. The researchers have carried out a systematic study in the aspects of drawing on foreign experience, theory exploration and status investigation. In terms of drawing on foreign experience, the legislative experience of the United States, Britain and South Korea has provided us with the important enlightenment for the research of disciplinary power of teachers in China. In terms of theory exploration, researchers have conducted a deep and broad study on the attributes, connotation, exercise principle and legislation of disciplinary power of teachers. In terms of status investigation, researchers have revealed the current situation and problems in exercising the disciplinary power of teachers, and discussed the reasons and the effective measures to take. In the future, the researchers should pay much attention to the study of educators' discipline thought and practice, foreign laws and regulations of disciplinary power of teachers, focus on the systematic study of legislation of discipline power of teachers, and promote the empirical study of disciplinary power of teachers.
