摘要
供给侧改革对当前的总体就业、就业结构,以及政府宏观调控带来了非常深远的影响。然而,当前劳动法由于对劳动者保护的过度倾斜,在供给侧改革下其逐渐显现出用人单位雇佣缺乏灵活性、人力资源成本过高、劳动法刻板保护模式等问题,对企业的成功转型造成了极大的困扰,其在降低企业竞争力的同时也导致劳动力需求的进一步下降,整体上不利于劳动者利益的保护。因此,健全基本民生保障制度、充分发挥市场调节作用、实行分层分类保护等是较为可行的完善路径。
The supply side reform has a far-reaching impact on the current overall employment, employment structure, and the government~ macroeconomic regulation and control. However, due to the excessive tilt protection to employee, under the background of the supply side reform, the current labor law is in trouble, because the employment lacks flexibility, cost of human resources is too high, and the protection model of Labor law is stereotype. It has caused great distress to the successful transformation of enterprises, while reducing the competitiveness of enterprises, but also led to further decline in labor demand. In general, it is not conducive to the protection of the interests of workers. Therefore, labor law needs necessary adjustment, through perfecting the basic livelihood guarantee system, give full play to the role of market regulation, and the implementation of classification protection measures, promote the supply side reform carried out successfully.
