摘要
大陆法系国家法学教育强调掌握法律条文和注释,依据法律规范实现法律关系的调整。在法律行为出现——引发后果——利益衡平过程中,要求充分发挥法律的标准性和工具性作用,而在法律行为出现的前端,即行为主体为何选择该行为,却未被法学研究和教育中赋予相应的位置。在法学课程中运用经济实验,使学生理解社会主体行为是如何选择特定法律行为,保证学生不仅掌握事后法律调节作用,更能明确法律条文对事前行为的影响,同时对立法的前瞻性和法律条文在实践中的指导性有清晰的认识。
The education of the continental civil law system emphasizes the command of legal provisions and notes, and the realization of adjustment of the legal relations by legal norms. In the process of a legal act of occurrence, consequence, and balance of interests, the standard and instrumental functions of the law are required to be brought into full play. However, the initiating cause of the legal action, namely, why the behavior subject chose the act, has not been givena corresponding importance in legal study and education. This paper used economic experiments in the law curriculum to help students of law better understand the behavior of the main social subject, the choice of a specific legal acts and the role of post-act legal regulation, and have a good command of provisions on the pre- action, the foresight of legislation and the guidance of law in practice.
