摘要
《民法总则》是统领整个民法典并且普遍适用于民商法各个部分的基本规则。《民法总则》的制定,基本确立了民法典的体系安排,对于协调《民法总则》与民法典分则的关系具有重要意义。《民法总则》应成为全面确认和保障私权的基本法,应充分彰显人文关怀的时代精神,强化对人格尊严的保护。结合《民法总则》,从民法、民事法律关系、民事权利、民事法律行为四个方面进行阐述,示明《民法总则》对民事权利的确认和保护具有全面性、时代性和开放性。
The General Principles of Civil Law governs the entire civil law and normally is applicable to the basic rules of civiland commercial laws. The making of the Gneral Principles of Civii Law establishes the civil law system, which has much signifi-cance to coordinating the general rules and specific rules of civil law. T e Gneral Principthe basic law of comprehensively confirming and protecting personal rights, mirroring the epochal spirit of reflecting humanisticcare and strengthening the protection of personal dignity. This paper expounds the Gneral Principles of Civii Law from the fol-lowing four aspects, that is, civil law, civil legal relations, civil rights and civil legal acts, and proves its features of compre-hensiveness , timeliness and openness in the the confirmation and protection of civil rights.
