摘要
我国司法体制改革已经进入了新阶段,其使命是通过司法制度改革,实现司法公正目标。在这些改革举措中,法官员额制的制度构建是这些司法体制改革的关键环节。员额制改革涉及现行司法体制的法官制度,直接面向中国法官职业化。推进员额制改革,必然涉及员额制的属性与建设,包括但不限于员额制的标准与机制、员额制下法官权威地位、法官权利与义务配置、法官责任与责任豁免等问题。员额制的构建应坚持法官权利义务的平衡理念,坚持法官个人责任原则,通过法官权力清单制度,建立法官责任豁免与法官责任终身追究相结合的机制。
Judicial system reform in China has entered into a new stage. Its mission is to achieve justice through the judicial system reform. In these reform initiatives, the construction of the system of judges＇ posts is a key aspect in the reform of these judicial systems. The reform of the staffing system involves the current system of judges of the judicial system and is directed towards the professionalization of Chinese judges. The reform of the staffing system will inevitably involve the membership and construction of the staffing system, including but not limited to the standards and mechanisms of the staffing system, the authority of judges under the staffing sys- tem, the rights and obligations of judges, the liability and liability waiver of judges and the occu- pational protection of judges. The construction of the post system should adhere to the concept of balance of judges＇ rights and obligations, insist on the principle of personal responsibility of judges, and establish a mechanism of combination of judges＇ duty of responsibility and lifetime liability of judge through the system of judge＇s power list.
