摘要
从本质上看,"四风"问题是行政伦理失范、法律规制缺失以及公共权力异化等多种因素相互作用的结果,必须综合运用政治、法律和管理等多种治理途径,才能扎紧制度的笼子,持之以恒地正风肃纪。其中,政治途径关注作风建设"目的"层面的治理,法律途径涉及作风建设"过程"层面的治理,管理途径强调作风建设"手段"层面的治理。政治、法律和管理途径的相互补充,有助于避免单一途径治理的片面性,兼顾作风建设的针对性与全局性,推动新时代的作风建设向纵深发展,让领导干部知敬畏、存戒惧、守底线,习惯在受监督和约束的环境中工作生活。
The essence of "four ill-working-ethos" is the result of the interaction of many factors such as the dissimilation of public power, the anomie of administrative ethics and the absence of legal regulation. Therefore, we must make comprehensive use of various governance approaches such as management, politics and law so as to improve the system and change the ethos of work and life of cadres. The management approach involves the "means" level, focusing on "cost-benefit analysis of outcome". The political approach involves the "purpose" level, focusing on "representation, responsiveness and accountability". The legal approach involves the "process" level, focusing on "due process of law". The mutual supplement of management, politics and legal approaches can not only avoid the shortcomings of a single approach, but also integrate the three levels of "means", "purpose" and "process", and take into account the pertinence and integrity of the construction of working-ethos mechanism. Therefore, cadres at all levels can abide by the rules and regulations and are accustomed to working and living in a supervised and constrained environment.
