摘要
我国继承法自20世纪80年代颁行,至今已三十余年未有修订,随着时代的发展,独生子女家庭的主流化,许多方面的粗糙与不完善日渐显现出来。由于篇幅所限,本文仅从法定继承与代位继承制度方面进行论述,提出扩大继承人范围、明确代位继承制度的依据与规则,以期抛砖引玉,使我国法定继承制度能顺应当今时代的发展。
The Law of Succession has been implemented for more than thirty years, with the development of the times, many problems of the rough and imperfect of the laws have gradually emerged. Because of the limited space, this paper only studies the legal heirs and subrogation inheritance system, tries to expand the scope of heirs, and clear the subrogation inheritance system, in order to make Chinese legal inheritance system adapting to the current situation.
