摘要
2015年修正的《中华人民共和国立法法》增加了立法规划的内容,但规定较为原则。我国立法实践中出现的问题与立法规划这一立法"源头"有一定的关系。纵观我国地方立法规划现状,目前还存在项目来源渠道较单一、内容重复、立法规划审批主体不统一等问题。有鉴于此,本文认为,应当在明确地方立法规划编制权归属、拓宽立法项目来源渠道、确保立项标准和内容的科学性、细化程序规则等方面做出努力,以完善地方立法规划。
Legislation Act adds some content of legislative plan,while the relevant part is too fundamental to put into ef- fect.Variety of problems in the local legislative practice is linked to the disorder in the source of legislation.Concerning the existing circumstances,we can find the project source of legislative plan is relatively singleness,the content appears so repetitive ,the subject of approval authority is divided.
