摘要
近十几年来,经济犯罪刑罚轻缓化已经成为世界范围内刑事政策的发展趋势。为了使我国经济犯罪刑罚改革跟上世界刑事法的发展潮流,同时又结合我国具体实际国情特点,使刑罚改革的理论探讨显得更具现实意义,经济犯罪轻刑化的讨论由此应运而生。文章以目前我国的经济犯罪刑罚模式的现状分析为切入点,指出我国经济犯罪刑罚模式中存在的不足,并提出了在宽严相济的形势政策指导之下对轻刑化进行改革的具体途径。
In the recent decade,the economic crime leniency has become a worldwide trend with the development of criminal policy.In order to make Chinese economic crime punishment of criminal law reform coincide with the worldwide developmental trend,and combine with the characters of Chinese actual situation,the theoretical discussion should be more significant on criminal law reform.Therefore,the discussion on economic crime leniency arises at the historical moment.This paper analyzes the current state of Chinese economic crime punishment mode as a starting point,then points out disadvantages in Chinese economic crime punish mode,finally puts forward the specific way to reform the punishment leniency under the guidance of the policy of 'tempering justice with mercy'.
