摘要 惩戒作为一种行之有效的教育手段被广泛运用于传统教育,然而在现代教育中,教师在本应行使惩戒权的时候却望而却步。教师惩戒权正面临逐步消解的困境,具体表现在:教育立法缺位,教师惩戒成无源之水;教师素养不足,教师惩戒被滥用或不用;社会舆论偏见,教师惩戒不堪重负;法律意识淡薄,权利救济无用武之地。加强教育立法、规范行使教育惩戒权利、引导舆论回归理性、积极开展普法教育是我们突破此种困境的当务之急与重中之重。 As an effective education method,punishment is widely used in traditional education. However,in modern education,teachers are discouraged when they should exercise the right of punishment. Teachers' punishment right is facing the dilemma of gradual dissolution,which is embodied in the absence of the legislation of education. Teachers' quality is lack,teachers' punishment is abused or not; the social public opinion bias,the teacher punishment is overwhelmed; the legal consciousness is weak,the right relief is useless. Strengthening education legislation,regulating the exercise of education punishment power,guiding public opinion to return to reason and actively carrying out education are the top priorities and priorities of our breakthrough.
