摘要
关于黑恶势力"软暴力"的规定方式、"软暴力"与暴力性手段的关联程度、"软暴力"手段的阶段性特征和恶势力的制度定位,最新规范文件与既有规范文件的规定有所不同。在当前"扫黑除恶专项斗争"中,一种颇具代表性的司法观点认为,"软暴力"可以是恶势力形成的基础性手段,恶势力利用"软暴力"实施的犯罪,无须以暴力性手段为基础,更无须以暴力随时付诸实施为条件。在"恶势力"已成为半正式制度的背景下,应当以法治思维为基础,以对规范的实质解释为方法,以刑事政策适时调整的妥当性为基准,明确恶势力及其利用"软暴力"犯罪的认定规则:以暴力性手段为基础,或者暴力性手段在全部违法犯罪活动中具有支配性影响力,是认定恶势力的必要要件,也是恶势力构成具体犯罪的手段特征。涉刑事案件的"软暴力",分为黑社会性质组织的"软暴力"、恶势力的"软暴力"与普通刑事犯罪中的"软暴力"三类,各有其特征,应分类判断,不可混淆。
The newest regulation of the definition and characteristic of＂soft violence＂is different from the existing rules. In the anti-mafia campaign,a representative opinion points out that the ＂soft violence＂isn＇t the base or the condition of the crimes committed by the mafia-like gangs. In the background that the ＂evil force＂has become semi-formal regulation,the system of anti-mafia campaign should build upon the foundation of rule of law,the substantial interpretation of the regulation and timely adjust of the criminal policy. Then it is necessary to explicitly stipulate the concept of ＂evil force＂and the identification of ＂soft violence＂crime. In conclusion,the violence and the influence of violent behavior in the crime is the basic criterion to identify the ＂evil force. ＂The＂soft violence＂in the crimes could fall into three types： ＂soft violence＂in crimes committed by mafia-like gangs,in ＂evil force＂crimes and in common crimes.
