摘要
大学生参与兼职不仅可以减轻家庭的负担,而且可以积累社会实践经验,为适应以后激烈的市场竞争积攒资本。但随之而来的合法权益受到侵害的现象也越发突出。究其根源,在于我国劳动立法至今没有对大学生兼职的法律性质进行认定,导致兼职大学生维权受阻。加之用人单位恶意规避法律不当聘用大学生,兼职网站管理混乱,以及大学生法律维权意识淡薄等原因,加剧了兼职大学生合法权益受侵害的程度。深入分析兼职大学生权益受侵害的原因,从完善立法、加强高校管理、规范用人单位责任、加强兼职网站管理等角度提出了保障兼职大学生劳动权益的建议,更好地帮助兼职大学生摆脱维权受阻的困境,以保障兼职大学生的合法权益。
The part-time job of college students is very popular on campus. It can not only reduce family bur-dens,but also accumulate social practice experience,so as to accumulate capital for future fierce market competi-tion. But the rights and interests of many part-time college students are damaged. The reason is that the labor leg-islation in our country has not identified the legal nature of college students’ part-time job so far,which hindersthe maintenance of rights. In addition,unlawful employment of college students by employers,confusing manage-ment of part-time websites,and college students’ weak awareness of rights aggravated the extent of infringementon the lawful rights and interests of part-time college students. This article analyzes the reasons for the damage tothe rights and interests of part-time college students,from the perspective of improving legislation,strengtheninguniversity management,standardizing the responsibilities of employers,and strengthening the management of part-time website,we put forward suggestions for ensuring the rights and interests of part-time college students. Thiscan help the part-time college students to maintain their legitimate rights and interests,and ensure the orderlyconduct of the part-time work.
