摘要
村民小组集体土地所有权主体地位消解于包产到户,至家庭联产承包责任制的建立则名存实亡。以集体土地所有权和承包经营权确权登记颁证为契机,将村民小组集体所有中的农户承包经营的耕地确权到户,有其理论上的正当性和实践中的合理性。农户承包耕地确权到户,家庭集体经营,既能最好地保障农民土地权益,政府进行严格的土地用途管制,又能较好地保住耕地红线和粮食安全,又没改变集体经济组织制度,是目前产权体制下较好的制度建构。
The collective land ownership began to lose its dominant position with the implementation of the policy of household production and has existed in name only since the establishment of the household contract responsibility system. There are both theoretical and practical justifications for making the confirmation registration of the collective land ownership and of the contractual fight of land an opportunity to let every family from the villagers group have their own land right. With their contractual right confirmed, farmers will enjoy guaranteed land rights. Meanwhile, a strict governmental control on land use will safeguard the red line of arable land and the food security thereby. Also, the collective economy, a sound system within the present framework of property rights, will remain intact.
