摘要
在民事法律活动中,政府行为的介入往往会引起民事法律关系的变动,甚至有可能会影响法律秩序的稳定。因此,准确界定政府行为的性质尤为重要。本文对因政府行为引发的商品房逾期交付的情形适用何种法律原则进行分析后认为,不可抗力或者情势变更均具有一定的合理之处,但在具体操作中,情势变更的适用具有较强的主观任意性,稳定性较弱;相比之下,不可抗力有着较为明确的法律规定,具有较强的规范性,在司法实务中可操作性较强,易于解决民事纠纷,更顺应我国市场经济的发展,符合我国的国情。因此,政府行为引发的商品房逾期交付情形适用不可抗力更为妥当,更利于保护合同当事人的合法权益,促进交易的完成。
In civil law activities,it often changes ci vil legal relationship when interposing government action,and then easily affects the stability of the rule of law.So it is important to define accurately the property of government action.In this article,aim to the situation that buildings delayed due to government action,I discussed which law system should apply compatibly.It has some reasonableness to apply force majeure system or apply the principle of change of circumstances.But In the practical application,the principle of change of circumstances has subjective arbitrariness,and it has weaker stability.By contrast,force majeure system have clear legal requirements,and it has a strong normative.So it is appropriate to applies to force majeure system.It can protect better legitimate interests of the parties and achieve transactions.
