摘要
在媒体融合年代,人们逐渐依赖新闻聚合等平台获取新闻,新闻聚合的版权许可问题直接影响到人们获取新闻,进而就新闻进行表达的权益。把版权许可创造性地划分为合理使用、法定许可、授权许可和默示许可四种类型,分别探讨这四种许可类型对新闻聚合版权争议的应用与调适,提出在《著作权法》中完善合理使用制度、引进默示许可制度、构建合理使用、授权许可和默示许可为一体的许可体系,以尽可能使新闻聚合的版权许可更有利于公众知情权和表达权的实现。
In the era of media convergence,people gradually rely on news aggregations to access news.Therefore,the copyright licensing issues of news aggregations directly affect people＇s access right and express right to news. This article creatively divides the copyright license into four types： fair use,statutory license,authorized license and implied license. On the basis of this,we discuss the application and adjustment of four license type in the field of news aggregation copyright,and then put forward the improvement of fair use and the introduction of implied license system in our copyright law,in order to construct various licensing system which is composed of fair use,authorized license and implied license,and make the copyright permission of news aggregation as far as possible which is more conducive to the realization of public＇s right to know and expression.
