摘要
在全国环境保护大会上,习近平总书记对新时代生态文明思想进行了全面论述。新时代中国社会基本矛盾的转变,对生态环境法治提出新需求。新时代环境法学基础理论的构建,必须立足于中国的政治发展道路,将生态文明建设的政治话语转化为法律话语、学术话语。新时代环境法学的发展,要构建法理分析的逻辑框架和理论体系。当前环境法学研究的重点问题包括适度推进法典化、长江流域立法和生态损害赔偿制度改革,应当注意的问题包括增强历史责任感,增强"人民主体"和"生活本位"的研究意识,将学术精力凝聚于主战场,通过高水平研究提升学科建设水平与人才培养质量。
At the National Conference on Environmental Protection,general secretary Xi Jinping gave a comprehensive exposition of the new era of ecological civilization.The transformation of basic contradictions in Chinese society in the new era raises new demands for the rule of law in ecological environment.The construction of the basic theory of environmental law in the new era must be based on the political development of China,and the political discourse of the construction of ecological civilization should be transformed into legal discourse and academic discourse.In the development of environmental law in the new era,we should construct the logical framework and theoretical system of legal analysis.The key issues in current environmental law research include moderate promotion of codification,Yangtze River Basin legislation and reform of compensation for ecological damage.The problems that should be paid attention to include strengthening the sense of historical responsibility,strengthening the research consciousness of"people’s subject status"and"living standard",condensing academic energy into the main battlefield,and improving the level of discipline construction and the quality of talent training through high level research.
