“特岗计划”政策执行中的交接界面与契约空间研究 被引量:7

The Study of Transitional Interface and Contractual Space during the Execution Process of“Special-post Plan”

摘要 本文运用新制度经济学的契约理论,围绕"特岗计划"政策和契约文本的现实情况,对"特岗计划"政策执行中主体间交接界面和契约空间进行了探讨。研究发现,"特岗计划"政策在主体间交接界面上存在缺失与模糊问题,包括契约空间存在"非合意"的强制签约、"信息不对称"下的契约内容隐匿、"不平等"与"不合理"的违约规定等扭曲与变异问题。建议在下一步的政策修订中,首先要明确政策主体间的职责,明晰的交接界面是政策执行控制的根本问题,应对每一个上下游政策主体的职责予以明确划分;其次要在政府与特岗教师之间建立基于法治政府的"契约-责任"张力关系,这是一种以交换为基础,以政府权力行使和双方责任担当为主导,相互依存、相互连结又相互制约的关系。 Employing the principal-agent contractual theory of new institutional economics, centering on the real world situation of the "special post"policy and contractual text of Shanxi province and China, the author explores the transitional interface and contractual space between the main bodies during the execution process of the "special post"plan. The research found that the problems of deficiency and obscurity exist in the transitional interface of the main bodies during the execution process of the"special post"plan. In the meanwhile, the barriers of forceful signing under the undesirable circumstance, the obstacles of the deficiency of contractual text under the condition of asymmetric information, and the distorted and mutant difficulties of unequal and irrational regulations exist in the contractual space. The author suggests the related department should give specific division to the responsibility of every superior and subordinate policy entity between the transitional interfaces and build up the"contract-responsibility"tensional relationship between the government and the"special post plan"teachers based on the legal government.
