摘要
责令限制生产制度是我国2014年修订的《环境保护法》在法律责任一章进行的一项制度创新,被认为与责令停产整治制度一起实现对旧法规定的限期治理制度的替代与改造。梳理规范与考察实践可知,理论界与实务界对于新《环境保护法》中责令限制生产的制度性质存在分歧与争议,进而引发法律解释适用与后续执法程序的不统一。学界主要在责令行政行为的法理基础与制度框架中讨论责令限制生产制度的性质与特征,主要有行政处罚、行政命令、行政强制措施等观点。辨析制度内涵与行政行为的本质特征,责令限制生产应当界定为一种行政命令,如此界定既符合一般法理,也契合制度演进的社会基础、社会深层结构,发挥其制度功能。
The system of ordering restrictions on production is an institutional innovatioLiability of the Environmental Protection Law issued in 2014. Ordeing restrictions on production andproduction suspension are regarded as the replacement and reform of deadline governance system stipulated inthe old law. However, as we can see from laws and practices, there exist different opinions in theory and practice fields about what the legal attribute of ordering restrictions on production is. And it’s these differences that cause the inconsistency between the kgal intrpretation application and following enforcement procedures. Scholars usually discuss it in the framework of the nature and characteristics in ordering restrictions onproduction and their opinions include administrative punishments, administrative orders, and administrative coercive measures. But we think it should be defined as an administrative order by discriminating theconnotation of the system and the essential characterstics of administrative action. Such a definition is inaccordance with general legal prnciples and deep institutions as well as socievolution, exerting its institutional function.
