摘要
城管执法场域中事端丛生、纷争不断的根源,乃在于城管主体、摊贩和周边居民三方之间及各自内部的利益分歧。由于这种复杂的利益纠葛难以或无法通过单纯的执法手段予以消除,因此需要构建一套开放而合理的协商机制来协调各方利益:以居民为支点的协商机制既包括居民参与城管执法,又包括自治形式的居民内部协商;以摊贩为支点的协商机制既包括自治形式的摊贩内部管理和外部维权,又包括其与城管的沟通、互动和交流;以城管为支点的协商机制则既包括对摊贩合法性、疏导点及相关问题的人性化管理,又包括共治形式下的开放居民参与。而在此之前,以城管为“连结点”或“中间人”并使三方主体同时在场的“三方共同协商”,则应具有更高的优先级。
The root of the disputes in the field of urban management law enforcement lies in the differences of interests among the three parties of urban management, the vendors and the surrounding residents. It is difficult or impossible to eliminate such complex conflicts of interests through simple means of law enforcement, so it is necessary to establish an open and reasonable consultation mechanism to coordinate the interests of all parties. Firstly, the consuhation mechanism based on residents includes both residents' participation in urban management law enforcement and residents' internal consultation in the form of autonomy. Secondly, the mechanism based on vendors includes not only the autonomous internal management and external rights protection, but also the communication, interaction and exchange with the urban management officers. Thirdly, the mechanism based on urban management includes the humanized management of the legality, guiding points and related issues of street vendors, as well as the open participation of residents in the form of cogovernance. Prior to this, the "tripartite consultation", where the urban management acts as a hnk point or middleman to make the three parties present at the same time should have a better priority.
