摘要
业委会成立难问题主要存在"维权工具说""利益相关说"和"权力意识说"三种解释路径,现有研究很少从业主组织成立流程视角进行剖析。根据环境-组织-行为三维视角构建一个宏观-中观-微观的诊断性分析框架,以寻找业委会成立难的根源所在。通过中美业主组织流程比较研究发现,影响业委会成立的核心是植根于宏观环境中的业委会的目标设定,其在整个业委会成立流程中起着主导作用,支配着包括筹备、选举、交接和备案等多个环节。从该视角出发,业委会成立难的问题应该从业委会目标替换、模式切换和流程再造三方面进行优化和改善。
There are three main explanations for the difficulties of establishing HomeownerAssociation, i.e., the tool of right-defending, stakeholder theory and consciousness of civil rights.The existing studies seldom analyze this problem from the perspective of the difficulties duringthe establishment. This study constructs a macro-medium-micro diagnostic analyzing frameworkaccording to the three-dimensional perspective of environment-organization-behavior.Through comparing the establishment process of HOA in China and the United States, the authorfinds that the core logic affecting the establishment of HOA is the goal setting of HOA, which isgrounded in macro social environment and dominates the process of preparation, election, handoverand filing. Therefore, the difficulties of establishing HOA should be solved from the perspectivesof object substitution, mode switching and process reengineering.
