摘要
解决法学教育和法律职业资格考试的衔接问题已成为国家关注的重要问题之一。分析我国既往关于两者衔接机制的相关研究,并考察3种国内专业学位教育与职业资格考试以及3种国外法学教育和法律职业资格考试的衔接模式。我国法学教育与法职考试衔接存在学术型硕士和专业性硕士培养模式趋同、法学类研究生招生考试效度偏低等问题。基于此,就报考条件、成绩认定、招生改革、培养过程等方面提出我国法学教育与法职考试衔接的相关建议。
Solving the problems of the coordination between legal education and legal professional qualification examination has become an important concern in the CPC＇s and state policy documents. The article analyzes the previous literatures on the coordination mechanism and analyzes the models of the coordination between the three domestic and three foreign higher education and professional qualification examinations. There are some problems in the coordination between legal education and legal professional qualification in China, such as the convergence of the training mode of academic master and professional master, and the low validity of legal graduate enrollment examination. Based on this, the article puts for ward some suggestions on the coordination between legal education and legal professional qualification in China in terms of application conditions,recognizing credits, enrollment reform and training process.
