摘要
知识产权在民事权利体系中占据重要地位,《民法总则》颁行之后,知识产权在民法典中的体系定位问题成为亟待解决的重点问题。当下,知识产权应当独立成编,但不宜整体纳入民法典中,而应采取"知识产权编+单行法"的立法模式。
The position-setting of the intellectual property in the system of the Civil Code is a serious problem after the General Principles of Civil Law enacted, because the Intellectual Property is an important part of the system of Civil rights. At present, the Intellectual Property should become independently and choose the mode of Intellectual Property Volume and Special Legislation, rather than bring whole Intellectual Property law into the Civil Code.
