Multiple Implications of “Reasonable” in the Labor Law and Its Application

摘要 "合理"是法学乃至整个人文社会科学领域较为常见的表达语词,也是在法律条文中高频出现的词汇。"合理"究竟是无法量化、含糊不清的生活化概念,抑或是有着多重意蕴、明确内涵的法律语言,这是学理与实践需要厘清的重要问题。解读"合理"在法世界中的多重意蕴不仅具有法律解释功能,而且具有法学方法论层面的特殊意义。从语义、语境、渊源等多方面解构"合理"一词,可得出"合理"在法学领域应用中的四种意涵:形式合理、实质合理、习惯合理、权衡合理,进而明确在何种条件下应适用何种解释框架,以期达致法律语言之严谨、学术话语之通达、法律适用之精准。 " Reasonable" is a common expression in the field of law and even the entire humanities and social sciences. It is also a high frequency word in the legal provisions. Whether "reasonable" is an unquantifiable and ambiguous life-oriented concept or the legal language with multiple implications and explicit connotations is an important issue to be clarified in theory and practice. The interpretation of the connotation of "reasonable" in the legal world not only has the function of legal interpretation, but also has the special significance of the methodology of law. This paper deconstructs "reasonable" from the aspects of semantics, context, origin and others, and concludes four meanings of "reasonable" in the application of legal field : "Rational", "Reasonable", "Usage/Tradition" and "Balancing", which analyses the choice of the applicable interpretation framework to achieve more rigorous legal language and more accurate legal application.
