摘要
我国目前阶段重大突发环境事件有责必问,有责必究,但是由于问责制度不完善,行政问责没有达到减少重大突发环境事件的发生。我国突发环境事件行政问责在问责原则、问责主体、问责客体、问责权限、问责程序等方面存有问题,我国突发环境事件行政问责应依法追责、统一问责主体、问责客体、明确问责范围、从严问责、问责程序公开化、具体化。
At present, China's major environmental emergencies are accountable. However, due to the imperfect accountability system, the administrative accountability has not been able to reduce the occurrence of major environmental emergencies. There are some problems in administrative accountability of environmental emergencies in China, such as those regarding the accountability principle, accountability subject, accountability object, accountability authority, accountability procedure and so on. Administrative accountability for unexpected environmental events should be improved in responsibility according to the law; the subject of accountability and the object of accountability should be united; the scope of accountability should be clarified, the accountability should be done with severity, and the procedure of accountability should be publicized and concretized.
