摘要
介绍德国土地整理的相关历史经验和方法,认为德国土地整理遵循土地补偿、费用均摊的基本原则,通过详尽完善的流程设计和独立仲裁咨询的组织架构,实行利益相关方的多元参与和以土地整理参加者联合会为核心的决策机制,实现了经济、社会、生态多重效益的整体目标,其中的成功经验值得借鉴。针对我国农村集体经营建设用地的统筹利用提出建议,包括以促进农村生产、生活、生态多元发展为目标,以保障集体土地所有权、镇级统筹建设用地指标为原则,采用政府引导、乡镇为主体、各方参与的组织协调模式,组建镇级农村集体经营性建设用地统筹利用主体,制定实施导向的流程设计及运营方式等。
This paper aims to put forward possible principles and strategies for the integrated planning and utilization of collective-owned constructible lands in rural China with reference to the German experience of land consolidation. It argues that, in line with the principles of land compensation and shared costs, the practice of land consolidation in Germany has achieved the goal of comprehensive development of economy, society, and environment through the detailed system design of multi-stakeholder participation, independent arbitration and counseling, and autonomous decision-making of participants＇ association. In the circumstance of China＇s rural land reform, the paper suggests that the integrated planning and utilization of collective-owned constructible lands in rural China should take the coordinated development of production, living, and ecology in the countryside as a general goal and the collective land ownership continuity and town-level construction land indicator coordination as a principle to build a mechanism that is government-led with towns and townships as the main body and the multi-stakeholder participation. Moreover, a specific organization should be set up as a key player, and a detailed implementation procedure should be well designed, so as to provide reference for the planning and implementation of collective-owned constructible lands in the rural areas.
