摘要
中日两国目前都面临着有组织犯罪日渐猖獗的问题,但两国的有组织犯罪的表现形式略有差别,中国称为"黑社会性质组织"犯罪,日本则称为"暴力团"犯罪,与中国的黑社会性质组织相比,日本暴力团的组织形式更为严密。本文对黑社会性质组织与暴力团的组织形式、组织特征、犯罪领域的变化、近年来的发展变化趋势等现状进行了分析,并在此基础上对这两种犯罪组织特征、主体、犯罪领域与方式、国际化程度等问题进行了比较。
Organized Crime becomes more and more rampant in China and Japan.There are some differences about the Organized Crime between Chinese law and Japanese law,in China it is called'underworld property organization',in Japan it is'Boryokudan'.The Boryokudan have tighter type of organization than the underworld property organization.In this paper,we will analyze the type of organization, character,change of crime area and variation trend of the underworld property organization and Boryokudan first,then we will make the comparative research about the organization character,subject,crime area and the way of crime,degree of internationalization between the two criminal organization.
