摘要
《民办教育促进法》及其《实施条例》作为规约民办教育发展的法律,与民办教师的切身利益紧密相关。民办中小学教师是基础教育阶段的一个特殊教师群体,由于民办教育政策法规的模糊性,使得其非正常性流动现象严重。民办中小学师资来源复杂,是流动的客观原因;"合理回报"的纠结,是流动的导火线;教师权益保障的虚假,是流动之现实性原因;"同等法律地位"的虚幻,导致流动成为必然。要缓解这种非正常性流动趋势,需有关人员共同努力,最关键是政策法规的相应条款要明确并具体落实。
Being the laws to rule and restrict the development of non-government funded education, "the Law of the People’s Republic of China on Promotion of Privately-Run Schools" and its Byelaw are closely related to the the teachers’ immediate interests in non-government school.Teachers who work in non-government primary and middle schools are the special group of elementary education,because of its policies and regulations’ blurry,the phenomenon of teachers’ flow becomes more and more seriously.Reasons are as follow,the objective reason is that,teachers’ identity complicated;the indeterminacy of "reasonable return",is the direct cause;the false interests and rights for teachers,is the fasibility reason;and the unreal of "the same legal status",lead the flow to be certain.To adjust this current situation,we need help from anybody who is related to.Otherwise,the most critical is that the articles of law must be put into practice definitely and specifically.
