摘要
行政强制执行是行政强制制度中不可或缺的一个方面,为保障行政决定及时、全面、有效地贯彻执行,发挥着重要作用。本文试以我国强制执行制度建立的必要性为切入点,通过揭示现行"以申请人民法院强制执行为原则,以行政机关强制执行为例外"执行模式面临的困境,旨在分析找寻适应社会主义市场经济体制和民主政治建设需要的行政强制执行制度的路向选择。
The Administrative Compulsory Execution,an indispensable part of the Administrative Compulsion System,plays an crucial role in guaranteeing punctual,all-round and efficient implementation of adminis- trative decision.By disclosing dilemma the current executive mode is facing,this paper attempts to start from the necessity of establishing Administrative Compulsory Execution System,and is dedicated to looking for the appropriate Administrative Compulsory Execution System suitable for socialist market economy as well as needed by the Democratic construction.
