摘要
与受托管理和自我管理不同,顾问管理型私募基金是指私募基金管理人通过担任投资顾问的方式,为信托、银行理财、券商、保险、期货、基金公司等资管计划提供投资顾问服务。而上述资管计划也是目前顾问管理型私募基金的主要类型,顾问管理型私募基金表现为一种信托法律关系,相应的资产管理机构应当履行受托人职责,同时顾问管理型私募基金又属于典型的契约型私募基金。但是,顾问管理型私募基金的法律依据和适用具有多元性,这增强了相应法律实务的专业性,值得业界注意。
Private equity fund managed by advisor means private equity fund manager will provide advisory ser?vice in investment to assets management schemes such as trust plan,wealth management of bank,broker,insurance,futures,fund management company,etc. The above-mentioned assets management schemes are the main types of thepresent private equity fund managed by advisor. They manifest as the trust legal relationship,and the assets manage?ment institutions should perform the duties of trustee. At the same time,private equity fund managed by advisor is con?tractual private equity fund. The legal bases and applications of private equity fund managed by advisor are manifold,which makes corresponding legal practice professional. We should pay attention to private equity fund managed by ad?visor.
