摘要
如何认定国家行为?首先要对国家行为进行界定,而国家行为是从国外引入的一个概念,没有一个统一的说法。因此,认定国家行为这一命题相对复杂。本文试图从基础定义入手,首先厘清它的概念、特征,其次说明分类,然后再对国家行为的范围进行认定,这是本文的重点内容。
How to identify state acts?The first thing to do is to define a state act. While the concept of state act is a borrowed one from foreign countries,and there is no uniform wording regarding the said concept. Therefore,it is a complex issue to identify state acts. The thesis attempts to start with the definition of state acts,the first part deals with its concept and characteristics,then the second part addresses its classification,last but not the least,the third part focuses on the identification of the range of state acts,which is the prime part of this thesis.
