摘要
随着中国经济的发展,许多国外的承发包模式也逐步引入进国内,在国内的环境下快速成长,如EPC总承包模式。EPC模式作为一种典型的工程总承包模式,EPC模式将工程项目设计-采购-施工和试运行工作交由工程总承包人完成。它具有建设周期长、施工情况复杂的特点,相较于DBB模式,EPC模式中承包人将承担更多的工程风险。工程变更后引起合同价款调整,给业主或总承包商带来利益受损,如何合理的规避这些问题是目前研究所欠缺的。本文的主要目标在于研究EPC模式下,工程变更引起的合同价款调整提供依据以及解决的办法,为最终达到承发包双方共赢的局面作出努力。
With the development of China's economy,many foreign contracting modes are also gradually introduced into China and rapidly developed under the domestic environment,such as the EPC mode.As a typical project general contracting mode,in EPC mode,project design-procurement-construction and commissioning work is completed by the general contractor.It has the characteristics of long construction period and complex construction situation.Compared with DBB mode,contractors in EPC mode will take more engineering risks.The contract price adjustment caused by engineering changes brings the damage to the interests of the owners or general contractors.How to properly avoid these problems is currently lacking in the research.The main objective of this paper is to study the basis and solution to contract price adjustment caused by engineering change under the EPC mode and make efforts to finally achieve win-win situation forboth parties.
