摘要
国际知识产权法律制度始于1883年签订的《巴黎公约》,经130多年至今已经形成WIPO与WTO管辖下两大相对独立又相互兼容的国际知识产权法律体系,及地区性或双边自由贸易/投资协议中的知识产权制度并存的格局。其总体趋势是知识产权保护水平在不断提高,范围在不断扩大。透过协议规定的背后可以发现,跨国公司等在国际知识产权法律制度的形成、发展过程中施加了影响,甚至某些规定就是它们意志的直接反映。这些对正在积极推行"走出去"战略与"一带一路"倡议的中国企业运用和保护知识产权而言,很有启示意义,为它们在未来的国际知识产权法律制度修正和完善过程中发出自己的声音,提供较有价值的借鉴。
The Paris Convention for the Protection of Industrial Property adopted in 1883 signified the beginning of international intellectual property legal regime,and in the past over 130 years,the regime has already developed into the pattern of the coexistence of two relatively independent international intellectual property legal regimes respectively under the administrations of WIPO and WTO with the mutual compatibility with each other,and regional or bilateral free trade and investment agreements containing the provisions concerning the intellectual property rights.The general trend of the present legal regime is that the level of intellectual property protection is constantly improving and the scope of intellectual properties is expanding.Through the provisions in the treaties,it has been found that behind the treaties,the transnational corporations have played a very important role in the process of formation and development of the international intellectual property regime,and even some provisions in the treaties are direct reflection of their wills.These are of great significance for Chinese enterprises which intend to actively exploit and protect intellectual property rights in advancing the strategy of“going out”and“The Belt and Road”initiative,for they provide more valuable reference for the enterprises to make their voices heard in the process of reconstructing and improving international legal system of intellectual property rights in the future.
