摘要
中宣部和司法部在"七五"普法规划中明确提出"要健全普法宣传教育机制,实行国家机关‘谁执法谁普法’的普法责任制"。各基层单位在落实该政策的过程中做出了一些成效,也积累了一些具有实战意义的方法和经验,但是远未实现"七五"规划中要求的"常态化"、"责任制"等相关要求。而普法任务全面落地的一个重要指标就是建立"谁执法谁普法"责任制。鉴于此,论文将从如何正确理解国家机关"谁执法谁普法"责任制以及其内涵等理论问题出发,分析国家机关"谁执法谁普法"责任制的法律及政策依据,厘清该普法责任制的主体范围,并进一步以基层政府的实践做法为研究范例,总结该普法责任制落实的机制以及路径,服务"七五"普法工作,乃至党的全面依法治国的战略大局。
In the"seventh five-yea"general law planing,the propaganda department of the central committee of the CPC and the ministry of justice of the people's republic of China have clearly put forward that it is necessary to perfect the publicity and education mechanism of law popularization and implement the responsibility system of the law popularization system of the state organs"who enforces the law who popularizes the law".The grass-roots units have made some achievements in the process of implementing the policy,and have accumulated some practical methods and experiences,but it is far from realizing the requirements of"normalization"and"responsibility system"in the"seventh five-year"plan.An important indicator of the comprehensive implementation of the task of popularizing the law is to establish the responsibility system of"who enforces the law who popularizes the law".In view of this,starting from the theoretical analysis of how to correctly understand the responsibility system of"who enforces the law and who popularizes the law"in state organs and its connotation,the paper analyzes the legal and policy basis for the responsibility system of"who enforces the law who popularizes the Law"in state organs,clarifies the subject scope of the legal responsibility system.Furthermore,taking the practice of grass-roots government as an example,this paper summarizes the mechanism and path of implementing the responsibility system of popularizing the law,so as to serve the"seventh five year"plan to popularize the law,and even the party's overall strategic situation of governing the country by law.
