摘要
我国关于非法集资犯罪涉案财物处置的法律规范不够完善,所规定的处置主体不够明确,处置范围不够清晰,处置程序存在缺陷。非法集资案件的司法实践中面临非法集资参与人的身份难以认定,涉案财物难以追回等困境。重构非法集资犯罪涉案财物处置机制,需要遵循彻底性与相当性相结合、民事损害赔偿优先、平等保护和适时保护相结合等原则,采取以司法机关处理为主、打击和处置非法集资工作领导小组处理为辅的处置模式,在刑事诉讼法中明确资产清算组、公安机关、检察院、法院对非法集资犯罪涉案财物的处置权限和程序,构建易贬值、难保管财物的应急处置程序,以及涉案财物的申报、清单流转、分配等配套程序。
Our country′s legal norms on the disposal of property involved in illegal fund-raising crime are not perfect,the disposal subjects are not determined,the disposal scope is not clear,and the disposal procedures are defective.In the judicial practice of illegal fund-raising cases,it is difficult to identify the identity of illegal fund-raising participants and recover the property involved.In order to reconstruct the disposal mechanism of property involved in illegal fund-raising crime,we should follow the principles of combination of thoroughness and equivalence,priority of civil damage compensation,the combination of equal and timely protection.Moreover we should adopt a new disposal mode which is dominated by judicial organs and supplemented by the leading group of combating and dealing with illegal fund-raising.At the same time,in the criminal procedure law,we should clarify the jurisdiction and procedures of the assets clearing group,public security organs,procuratorates and courts in dealing with the property involved in illegal fund-raising crimes,and establish emergency procedures for dealing with the property that is easy to depreciate and difficult to keep,as well as the supporting procedures of declaration,list circulation and distribution of the property involved.
