摘要
面对矛盾多发和社会治理创新的双重要求,调解制度逐渐走向完善。"警调衔接"机制将公安机关执法与人民调解有机结合,实现了机制顺畅衔接,为实现缓解基层公安机关工作压力、促成社会矛盾化解、构建和谐社会关系发挥了重要作用。但实践的复杂性、社会环境的急剧变化、调解本身具有的缺陷,使得这一机制在运用中面临着程序、效力和结果三个方面的风险考验,通过法治化改造,完善证据制度、引入诚信制度、改造司法确认制度,可以推动这一机制不断走向完善。
In the face of the double demands of contradictions and social governance innovation,the mediation is gradually improved."Police and Mediation Cohesion"organically combines the police affairs with the people's mediation and realizes the smooth convergence of the conflict resolution mechanisms,which plays an important role in alleviating the pressure of grassroots police unit,promoting the resolution of contradictions and building harmonious social relations.But the complexity of practice,the dramatic change of social environment and the defects of mediation itself lead to three risks in its application:procedure risk,effectiveness risk and result risk.Through the reform of the rule of law,the perfection of the evidence system,the introduction of the system of good faith and the reform of the judicial confirmation system,the mechanism can be continuously improved.
