摘要
信息化时代的到来和我国社会主要矛盾发生转变的现实,要求转变传统的犯罪治理思路,让刑法更多地参与到社会治理的工作中去并逐步实现犯罪治理智能化、专业化。但考虑到刑法本身兼具的救济性和剥夺性、信息网络技术的两面性,刑法参与社会治理的前提在于树立全新的刑法观、犯罪治理观。一种以马克思主义基本原理为指导、结合了新时代中国特色社会主义思想、更加关注"人"的刑法观念的确立既具有现实基础,又符合时代精神。未来在此观念引领下开展的犯罪治理工作,应将刑事法治的出发点和落脚点回归于"现实的人",实现个人、社会、自然的整体和谐。
The advent of the information age and the reality of the major social contradictions in China require the transformation of traditional criminal governance ideas,so that criminal law becomes more involved in the work of social governance and gradually realize the intelligent and professional crime management.However,considering that the criminal law has both sides of relief and the deprivation,the pros and cons of information network technology,the premise of criminal law's participation in social governance lies in establishing a new view of criminal law and criminal governance.The establishment of a criminal law concept,guided by the basic principles of Marxism,combining the idea of socialism with Chinese characteristics in the new era and paying more attention to"people",has both a realistic basis and is in line with the spirit of the Times.In order to realize the overall harmony of the individual,the society and the nature,the criminal legislation and judicial work under the guide of this theory should return the starting point and the landing point to the"real individual".
