摘要 促进高龄劳动者就业不仅是应对人口老龄化的重要手段,也是世界各国推进国家治理的普遍经验。但高龄劳动者由于受心理、生理及劳动技能等因素的影响在劳动就业中经常面临就业困难等问题,其中容易遭受年龄歧视是最大的问题之一。就业促进中的年龄歧视是一种妨碍效率与社会公平的主观偏见,它阻碍了人力资本的正常流动,破坏了公平的就业环境,加剧了社会矛盾。高龄劳动者就业中的年龄歧视不仅给公平就业设置了障碍,还侵害了劳动者的合法权益而成为现代法律规制的对象。运用法律规制高龄劳动者就业中的年龄歧视,不但能切实保障高龄劳动者的生存权、平等权和就业权,还能充分使用高龄劳动者的人力资源,为应对人口老龄化发挥积极作用。 Promoting the employment of aged workers is not only an important means to deal with the aging of the population,but also a common experience in promoting national governance in all countries of the world.However,due to psychological,physiological and labor skills,the aged workers often face employment difficulties in labor and employment,and age discrimination is one of the biggest problems.Age discrimination in the employment of aged workers is a subjective prejudice that hinders efficiency and social equity.It not only hinders the normal flow of human capital,but also undermines the fair employment environment and exacerbates social conflicts.Age discrimination in employment sets obstacles to fair employment and violates the legitimate rights of workers,which becomes the regulation object of modern legal.The use of laws to regulate age discrimination in the employment of aged workers can effectively guarantee the rights of subsistence,survival and equality,and can enable the human resources of the aged workers to play an active role in coping with aging.
