摘要
生前预嘱制度有利于防止医疗父权的滥用,有助于化解患者家属代理行为中的伦理困境及利益冲突。我国大陆地区应在借鉴我国台湾和香港地区相关经验的基础上,采用渐进式策略来确定生前预嘱制度。
This paper argues that living will system is conducive to preventing the abuse of medical paternity and resolving the ethical dilemma and interest conflict in the agency behavior of patients'family members.Based on the experiences of Taiwan and Hong Kong,the Chinese mainland should adopt the progressive strategy to set up the living will system.
