摘要
企业新型学徒制是我国政府当前着力推行的职业培训模式,具有双元的培训内涵与价值。但是,该制度仍以政策为主导,存在企校合作的割裂、企业参与的积极性不高、培训过程缺乏相应的标准与监管、法律关系定位不够清晰的问题。我国应当立足于劳动力市场的现状,以法律的形式加快推进学徒培养的法制化,以增强学徒培养的重要性,并调动各方行政管理主体的配合;完善对学徒培训方案的规范,保障培训方案的标准化与灵活性;加强对企业参与学徒培训的财政补贴,降低其面临的学徒违约风险,以提高其参与学徒培训的积极性;准确定性学徒的法律身份,为学徒提供适当的劳动法保障,并打击虚假培训的行为。
The new apprenticeship system of enterprises is a main training mode that our government is currently implementing.It has the connotation and value of dual-training.However,the system is still promoted by policies.There are problems such as the fragmentation of enterprise-school integration,lack of corresponding standards and supervision in the training process,low enthusiasm of participation for corporate and unclear positioning of legal relationships.Based on the status quo of the labor market,China should accelerate the legalization of apprenticeship training in the form of law to strengthen the importance of apprenticeship and promote the cooperation of all parties involved in the administration;improve the norms of apprenticeship training program,including standardization and flexibility;strengthen financial subsidies for enterprises and reduce the risk of apprenticeships they face in order to strengthen the enthusiasm of enterprises to participate in apprenticeship training;clear the legal status of quasi-deterministic apprentices,provide apprentices with appropriate labor law protection,and fight against false training.
