摘要
民事行政诉讼监督经过40年的发展,已经成为检察机关进行法律监督行使检察权的重要组成部分。实务中,民事行政诉讼检察监督存在着制度不健全、能力不充分、监督力度弱等问题,其重要原因之一就是民事行政诉讼监督专业化程度低,难以体现对司法审判权监督的权威性。适应新形势新任务新要求,加强对民事行政诉讼监督的顶层设计、建立专业化监督队伍、开展专题培训与案例式教学、创新民事行政诉讼监督分类办案机制是解决该问题的有效途径。
After 40 years of development,supervision of civil administrative litigation has become an important part of procuratorial organs'legal supervision and exercise of procuratorial power.In practice,the procuratorial supervision over civil administrative litigation has some problems,such as imperfect system,inadequate capacity and weak supervision.One of the important reasons is that the supervision of civil administrative litigation has a low degree of specialization,and it is difficult to reflect the authority of supervision of judicial jurisdiction.To adapt to the new situation,new tasks and new requirements,it is an effective way to solve this problem to strengthen the top-level design of civil administrative litigation supervision,establish professional supervision team,carry out special training and case-based teaching,and innovate the classification mechanism of civil administrative litigation supervision.
